Marcelo Dickstein publishes book
Marcelo Dickstein, associate at Andrade & Fichtner law firm, published the book “Objective good-faith in the tacit modification of the legal relationship: Surrectio and Suppressio”, with Lumen Juris Publisher.
In the book, the author closely examines two institutes which have not been disseminated in Brazilian Law: surrectio and suppressio. Derived from the objective good faith’s limiting function, which rules and restricts the exercise of certain rights, both institutes have Germanic origin and are examples of tacit modification of the legal relationship over time. From this perspective, the author demonstrates that the parties’ conduct is capable of modifying obligations, sometimes giving rise to a right that previously did not legally exist, but that socially was perceived as present – with the incidence of surrectio – or by suppresing a right that was not socially effective – due to suppressio. Thus, the author examines the consequences and practical implications of such institutes in daily life.
The work is a result of his experiences at Andrade & Fichtner, is based on up-to-date doctrine and case law, and has the objective of contributing to the development of the issue among jurists.
